Six Friends Deny Rioting Charge Over Mount Austin Attack

JOHOR BAHRU: Six friends were brought before the Johor Bahru Sessions and Magistrates Court on Thursday, where they pleaded not guilty to serious charges linked to a violent incident that left a man injured in Taman Mount Austin last December. The early morning case has drawn attention due to the alleged use of multiple weapons in a public place.

The accused are Choy Soon Chye, 41, Soh Say Shin, 36, Soo Toh Siang, 30, Calvin Phua Khim Hau, 29, Yap See Hong, 26, and Tan Shen Qi, 21. All six made their pleas after the charges were read before Sessions Court Judge Datuk Ahmad Kamal Arifin Ismail.

According to the charge sheet, the group is accused of intentionally causing serious injuries to a 28-year-old man, Low Chun Yong. The prosecution alleged that weapons capable of causing death were used during the attack, including a meat cleaver, a taser gun, a plastic chair and an iron rod. The offence was said to have taken place in front of a restaurant in Taman Mount Austin at about 3.30am on December 27 last year.

Deputy Public Prosecutor Mohamad Afdhallan Syafiq Azmy appeared for the prosecution. Five of the accused were represented by lawyer T. Haresh, while one was represented by Amarpreet Singh Rajwinder Singh.

After hearing submissions from both sides, the court allowed bail of RM10,000 for each accused. The judge also imposed additional conditions, including the surrender of international passports to the court and a requirement for the accused to report once a month at the nearest police station.

On the same day, all six accused were also charged separately at the Magistrate’s Court for participating in a riot and for possession of a knife and a plastic chair, which were allegedly used as weapons at the same location, date and time. They again pleaded not guilty when the charges were read before Magistrate Muhammad Fitri Mokhtar.

This second case was handled by Deputy Public Prosecutors Mohamad Afdhallan Syafiq Azmy and Siti Aishah Latif. Five of the accused were again represented by T. Haresh, while Calvin Phua Khim Hau was represented by Amarpreet Singh Rajwinder Singh.

The Magistrate’s Court granted bail of RM3,500 for each accused, with stricter conditions including three sureties per accused, regular reporting to the nearest police station and surrender of passports to the court.

Both courts fixed February 3, 2026, for the cases to be mentioned again and for the submission of relevant documents. Until then, the accused remain free on bail while awaiting further proceedings.
