The accused, Nur Farhana Fazmar Abdullah, nodded in understanding after the charge was read before Magistrate Nurul Rasyidah Mohd Akit. However, no plea was recorded as murder cases fall under the jurisdiction of the High Court.

According to the charge sheet, the accused allegedly caused the death of the infant at Taska Pintar Hospital Seberang Jaya, located within the compound of Hospital Seberang Jaya, between 1am and 4am on March 9.

The charge was framed under Section 302 of the Penal Code, which carries the death penalty upon conviction, or imprisonment of up to 40 years and not less than 12 strokes of the cane if the death penalty is not imposed.

Deputy Public Prosecutor Siti Nur Amalina Harun appeared for the prosecution, while the accused was represented by counsel Muhaimin Hashim. The court did not allow bail and fixed June 23 for mention, pending the submission of chemical and post-mortem reports.

In the same court, another 22-year-old woman who had previously been detained to assist in investigations was released on RM10,000 bail after being classified as a prosecution witness.

Penang Police Chief Datuk Azizee Ismail had earlier confirmed that the cause of death was drowning, based on post-mortem findings. The baby was pronounced dead at 4.20am on March 9 after being rushed to the Emergency Department of Hospital Seberang Jaya in an unconscious state.

It is understood that doctors performed cardiopulmonary resuscitation for nearly an hour in an effort to save the infant. Despite continuous medical intervention, the child could not be revived.

Initial information revealed that the baby had been sent to the 24-hour childcare centre by his mother, a nurse who was on night shift duty at the time of the incident.

The case has raised pressing questions regarding monitoring procedures and overnight care practices at childcare centres operating round the clock. Authorities are expected to complete investigations once forensic and chemical analyses are finalised.

As the matter now proceeds to the High Court, the public will be watching closely. The safety of infants placed under institutional care remains a serious responsibility, and this case serves as a reminder that childcare providers must adhere strictly to established regulations and standards. – Bernama
