Wan Junaidi: Spirit of MA63 Must Be Preserved Amid Legal Challenges

KUCHING – Sarawak Governor Tun Pehin Sri Dr Wan Junaidi Tuanku Jaafar has underscored the need to preserve the original spirit of the Malaysia Agreement 1963 (MA63), warning that certain court decisions could risk undermining the agreement’s intent and impact the state’s autonomy.

Speaking during the ICM Dinner held in conjunction with the inaugural ‘Bencher’ Award Ceremony on Saturday, Tun Wan Junaidi raised concerns about judicial interpretations that may override specific provisions of MA63 — particularly Sarawak’s immigration authority.

He cited the Immigration Act as an example, where the Sarawak Government holds powers to restrict the entry of individuals into the state. However, judicial rulings questioning whether such powers align with the Federal Constitution could potentially violate the spirit of MA63.

“If this happens, the entire meaning of the Malaysia Agreement will change completely because the original spirit of the agreement will be set aside by the basic structural doctrine,” he stated.

Although MA63 is not explicitly included within the Federal Constitution, Tun Wan Junaidi emphasised its enduring legal and political relevance in defining the federal-state relationship. He cautioned that if courts do not recognise immigration rights as part of the basic structure, then the autonomy historically afforded to Sarawak and Sabah would be vulnerable to judicial reinterpretation.

“Immigration powers are considered something very fundamental to the people of Sarawak and Sabah,” he added, stressing the historical significance of these rights in the formation of Malaysia.

The event was attended by an array of distinguished guests, including the Sarawak Governor’s wife Toh Puan Datuk Patinggi Fauziah Mohd Sanusi, Deputy Prime Minister Dato Sri Fadillah Yusof, US Ambassador to Malaysia Edgard D. Kagan, and several top Malaysian judiciary figures and federal ministers.

The remarks by the Governor come at a time when state-federal relations continue to be scrutinised, particularly in regard to state rights guaranteed under MA63.
