KUCHING, June 5, 2024: A 40-year-old man has been fined a total of RM6,000 by the Magistrates’ Court in Kuching for committing mischief and causing hurt to his neighbour’s brother.

Magistrate Syarifah Fatimah Azura Wan Ali imposed the fine on Mohamad Mas Rizan Mohamad Nazruni after he pleaded guilty to charges under Section 427 of the Penal Code for committing mischief and Section 324 of the Penal Code for causing hurt.

Mohamad Mas Rizan carried out these offenses at a residence in Kampung Astana around 10 am on May 30, 2024.

Incident Details:

According to the case’s facts, Mohamad Mas Rizan’s neighbor, the complainant, witnessed him breaking her house’s window with a rock and assaulting her brother with a piece of wood, resulting in injuries. The damages incurred amounted to approximately RM50, and the complainant’s brother suffered injuries to his face, back, and arm.

A police report was promptly filed, leading to Mohamad Mas’s arrest.

In addition to the charges of mischief and causing hurt, Mohamad Mas Rizan faced additional penalties for drug abuse.

Drug Abuse Charges:

In the same court proceedings, Mohamad Mas Rizan was fined a total of RM5,000 for two charges of drug abuse. These charges were framed under Section 15(1)(a) of the Dangerous Drugs Act 1952 and are punishable under Section 15(1) of the same Act.

He was found to be positive for amphetamine and methamphetamine during tests conducted by the Kuching district Narcotics Crime Investigation Department (NCID) on February 18, 2024, and March 2, 2020.

All cases were prosecuted by ASP Arman Ibrahim, while Mohamad Mas Rizan represented himself without legal counsel.
