Miri Employee Jailed Six Months for Property Misuse

MIRI – A 35-year-old company employee was sentenced to six months’ imprisonment and one stroke of the cane by the Miri Magistrate’s Court on 10 July 2026 after being found guilty of dishonestly misappropriating property under Section 403 of the Penal Code.

The case stemmed from an incident on 26 June 2026, when a company director discovered discrepancies during an audit of cash payment invoices at a business operating in Centre Point, Miri. The audit revealed that sales proceeds did not match the invoices recorded, leading to suspicions about the accused’s handling of customer payments.

Investigations confirmed that the employee had failed to hand over RM792.05 received from a customer to the company clerk, instead using the money for personal purposes. The offence was classified as fraudulent misuse of property, a serious breach of trust under Malaysian law.

The court handed down a custodial sentence of six months and ordered one whipping, reflecting the gravity of the offence and the need to uphold accountability in financial dealings. The ruling serves as a reminder that dishonesty in the workplace carries significant legal consequences.

Miri District Police Chief emphasised the importance of respecting the law, noting that the Royal Malaysia Police (PDRM) remains committed to enforcing justice fairly and efficiently. He urged the public to cooperate with authorities by reporting suspicious activities promptly, stressing that community vigilance is vital in maintaining the rule of law.

“This case highlights the importance of integrity in employment and the responsibility of individuals to act honestly in handling company resources,” he said.

The police further encouraged members of the public to channel information to the Miri District Police Headquarters or the nearest police station. Such cooperation, they noted, is essential in ensuring that offences are detected early and dealt with effectively.

Fraudulent misuse of property is a criminal offence that undermines trust between employers and employees. Legal experts point out that Section 403 of the Penal Code is designed to protect businesses and individuals from dishonest acts that cause financial harm. Convictions under this section can result in imprisonment, whipping, or fines, depending on the severity of the offence.

The sentencing in Miri reflects broader efforts by Malaysian authorities to reinforce transparency and accountability in both public and private sectors. By prosecuting cases of misappropriation, the courts aim to deter similar offences and safeguard the integrity of financial transactions.
